Terms of Service

These Terms of Service (“Terms”) are an agreement between you and DayTrellis LLC (“DayTrellis,” “we,” “us”). By creating an account or using DayTrellis, you agree to these Terms. If you do not agree, please do not use the service.

1. Who can use DayTrellis

You must be at least 18 years old and able to form a binding contract. By using DayTrellis you confirm that you are. DayTrellis is not directed to children. You may add a child profile for a child you support; that child is not a user of the service, and you are responsible for the information you enter about them.

2. What DayTrellis is (and is not)

DayTrellis is a holistic coaching experience for wellness and education. It is not medical advice, diagnosis, or treatment, and using it does not create a clinician-patient relationship. Your quiz results describe a profile, not a diagnosis. DayTrellis is not for emergencies. If you are in crisis, in the US call or text 988 (Suicide and Crisis Lifeline), available 24/7. Always talk to a licensed professional about your health.

3. Your account

Keep your login details accurate and secure. You are responsible for activity under your account. Tell us promptly at support@daytrellis.com if you suspect unauthorized use.

4. Plans, billing, and cancellation

• Plans. DayTrellis offers a free tier and paid subscription plans. The features included in each plan are described at sign-up.
• How you are billed. Paid plans purchased on our website are billed through Stripe. Plans purchased through the Apple App Store or Google Play are billed and managed by those stores under their terms.
• Trial. Paid plans begin with a 30-day free trial. We do not charge you during the trial. The free trial is available once per account. If you do not cancel before it ends, your plan begins and your card is charged at the price shown when you signed up.
• Automatic renewal. Plans renew automatically at that price until you cancel. We email you before your first charge.
• How to cancel. You can cancel at any time in your account settings. Cancelling stops the next charge, and you keep access until the end of the period you have paid for.
• Annual refunds. Annual plans bought on daytrellis.com: if you ask for a refund within 14 days of your first annual charge, we will refund that charge in full. Write to support@daytrellis.com. After 14 days, and on renewal charges in later years, annual payments are not refunded.
• Monthly refunds. Monthly plans bought on daytrellis.com are not refunded. You can cancel at any time and keep access until the end of the month you have paid for.
• App-store purchases. Purchases made through the Apple App Store or Google Play are covered by Apple’s or Google’s refund policies. We cannot issue refunds for those purchases, and you will need to ask the store you bought from.
• Price changes. Prices may change; we will give notice before a change affects you.

5. The AI coach

The coach generates responses using AI and may be inaccurate or incomplete. Use your own judgment, and do not rely on it for medical, legal, financial, or emergency decisions.

6. Acceptable use

Do not misuse the service. For example, do not break the law, infringe the rights of others, attempt to disrupt or reverse-engineer the service, scrape it, or use it to harm yourself or others.

7. Your content

You keep ownership of the content you create, such as your plans and messages. You grant us a limited license to store and process it as needed to operate the service for you. You are responsible for the content you provide. We retain it only as described in our Privacy Policy, and you can ask us to delete it at any time.

8. Our content

DayTrellis and its content, features, and branding are owned by DayTrellis LLC and protected by intellectual-property laws. We grant you a personal, non-transferable license to use the service, and we keep all other rights.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, error-free, or that any particular result or outcome will be achieved.

10. Limitation of liability

To the fullest extent permitted by law, DayTrellis and its owners will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify DayTrellis against claims arising from your misuse of the service or your violation of these Terms.

12. Termination

You can stop using DayTrellis and delete your account at any time. We may suspend or end access if you violate these Terms or to protect the service.

13. Changes

We may update the service or these Terms. For material changes to the Terms we will update the date above and provide reasonable notice. Continuing to use DayTrellis after changes take effect means you accept them.

14. Governing law and venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Ohio for any dispute that is not otherwise resolved.
